New York Governor Removes Local Prosecutor from Cornell Fraternity Rape Case, Assigns Attorney General

New York Governor Kathy Hochul has taken the extraordinary step of removing the Tompkins County district attorney from overseeing the investigation into an alleged gang rape at Cornell University, instead appointing the state's attorney general to handle the politically charged case as a special prosecutor. The decision, announced this week, marks a significant escalation in a matter that has drawn intense national scrutiny since a civil lawsuit was filed last month.

The case centers on allegations that a female student was drugged and sexually assaulted by multiple men at a fraternity house on the Ivy League campus in 2024. The woman, identified only as Jane Doe in court filings, claims seven men participated in the attack. The accused individuals have since become known in media coverage and campus discourse as the "Cornell Seven." The university has stated it conducted its own investigation and turned over evidence to local authorities, including a Snapchat group conversation in which fraternity members allegedly discussed a "free" sexual encounter with the woman on the night in question.

Hochul said new information that has surfaced in recent weeks raised troubling questions about the integrity of the earlier handling of the case. In a statement explaining her decision, the governor said she had lost confidence in the ability of the Tompkins County district attorney, Matthew Van Houten, to conduct a fair and thorough review. "New information has raised serious questions about how this case was handled, and I've lost faith in the Tompkins County DA's ability to fairly oversee it," Hochul said.

The governor also emphasized that the alleged victim deserves a process that examines every relevant fact. "The young woman at the center of this case deserves to know that every fact will be examined and justice pursued," she said. Under the arrangement announced by Hochul, the state attorney general, Letitia James, will lead the investigation. If the evidence warrants, the attorney general's office could prosecute any offenses uncovered and present findings to a grand jury.

James, the state's chief legal officer, responded publicly on social media, saying she was prepared to lead a process grounded in both the facts and the law. "The Governor has entrusted my office with this investigation, and we do not take that responsibility lightly," James wrote on X, formerly Twitter. Hochul and James were scheduled to provide a joint update on the investigation on Friday morning local time.

Van Houten, the county's top prosecutor, had initially declined to bring charges when the allegations first emerged in 2024. He has defended that decision, saying his office lacked sufficient evidence to meet the legal threshold for prosecution. According to Van Houten, the only statement available to his office at the time came from the woman herself and suggested the encounter was consensual and that she had not been drugged. He has maintained that crucial information uncovered by the university's own investigation was never provided to his office.

In a notable reversal, Van Houten announced earlier this week that he would reopen the case—a move that came less than two weeks after Doe filed her civil lawsuit. The lawsuit, filed in September against Cornell University, alleges that the institution failed to protect the woman and did not adequately discipline the men accused of the assault. Cornell has said it cooperated with law enforcement by supplying evidence from its internal investigation, including the Snapchat group chat among fraternity members.

The decision by Hochul to appoint a special prosecutor strips Van Houten of authority over a case he had only recently reopened. The BBC said it reached out to Van Houten's office for comment but did not receive an immediate response. The governor's action underscores growing concerns about how local authorities handled the initial investigation and whether the district attorney's office had access to all relevant evidence.

Thomas Giuffra, an attorney representing Doe, has accused Van Houten of repeatedly changing his account of events as media coverage of the case intensified. Giuffra's criticism reflects broader frustration among the woman's supporters, who argue that the local justice system failed her at multiple stages. In addition to the criminal investigation, the civil lawsuit has thrust the case into the national spotlight, raising questions about how universities respond to allegations of sexual violence within Greek life organizations.

The case has also sparked debate on the Cornell campus, where students have voiced anger and frustration at public hearings. The allegations have prompted wider discussions about the culture of fraternities, the handling of sexual assault complaints by university administrators, and the role of local prosecutors in pursuing cases that involve multiple defendants and complex evidence. Legal experts note that special prosecutor appointments are relatively rare and typically occur when there is a perceived conflict of interest or a breakdown in public trust.

By assigning the case to the attorney general, Hochul has effectively elevated it to a state-level matter. If James's investigation produces sufficient evidence, it could proceed to a grand jury, where prosecutors would seek an indictment. The outcome could have significant implications not only for the individuals accused but for how similar cases are handled in New York and beyond. For now, all eyes are on the upcoming briefing from Hochul and James, as the woman at the center of the case continues to await what she hopes will be a full and fair reckoning.
